Terms of Service

1. Who we are

VupiCard services are offered by [COMPANY LEGAL NAME], [COMPANY REGISTRATION NUMBER], headquartered at [REGISTERED OFFICE ADDRESS] ("VupiCard", "we", "us"). VupiCard is a technology company and is not a bank. Regulated services, such as safeguarding of funds, payment processing, foreign exchange and card issuing, are provided by licensed partner institutions ("Partners"), whose supplementary terms may apply.

2. Services

VupiCard offers: (a) a multi-currency digital account to receive and hold balances; (b) currency conversion; (c) transfers between accounts; and (d) a prepaid debit card, virtual and/or physical, linked to your account balance. Availability of each feature may vary depending on your country of residence and verification level.

3. Eligibility

• Be at least 18 years old and have full legal capacity;
• Reside in a supported country and not appear on any sanctions list (UN, OFAC, EU, UK, among others);
• Provide true, complete and up-to-date information;
• Hold only one personal account, in your own name.

4. Identity verification (KYC)

To comply with anti-money laundering and counter-terrorist financing laws, we require identity verification before funds can be moved, and we may at any time request additional documents and information, including about the source of funds. Refusal or delay in providing them may result in limitation, suspension or closure of your account.

5. Account and security

You are responsible for keeping your credentials, devices and authentication codes confidential, and for all transactions carried out with them. Report any unauthorized use immediately to [email protected].

6. Debit card

• The card is personal and non-transferable, issued by a Partner under license from the card network.
• Purchases and withdrawals are debited from your available balance; no credit is extended.
• Transactions in a currency other than your balance currency are subject to conversion and to the fees listed on the Fees page.
• You must freeze the card immediately in case of loss, theft or suspected fraud.

7. Fees

Applicable fees are published on the Fees page and are shown before you confirm each transaction. Changes will be communicated at least 30 days in advance, except where required by law or where fees are reduced.

8. Prohibited activities

You may not use VupiCard for, among other things:

• Money laundering, terrorist financing, fraud or any illegal activity;
• Unlicensed gambling, weapons, illegal drugs, illegal adult content or exploitation;
• Pyramid schemes, financial scams or the sale of counterfeit goods;
• Evasion of international sanctions or transactions involving sanctioned jurisdictions;
• Using the account on behalf of or for the benefit of undisclosed third parties.

9. Suspension and closure

We may limit, freeze or close your account, hold funds or decline transactions where there is suspected fraud, a breach of these Terms, a legal requirement or an order from a competent authority. You may close your account at any time; any remaining balance will be returned to an account in your name, subject to applicable checks.

10. Disputes

Unrecognized transactions must be disputed within 60 days of the transaction date, in accordance with our Cancellation and Refund Policy and card network rules.

11. Limitation of liability

To the maximum extent permitted by law, VupiCard is not liable for indirect damages, loss of profits, unavailability of third-party services, merchant refusals or force majeure events. Nothing in these Terms limits any consumer rights granted by applicable law.

12. Intellectual property

The VupiCard brand, website, app and their content are owned by or licensed to us, and may not be used without prior authorization.

13. Changes to these Terms

We may update these Terms. Material changes will be communicated by email or in the app with reasonable notice. Continued use after the effective date constitutes acceptance.

14. Governing law and jurisdiction

These Terms are governed by the laws of the country where VupiCard is headquartered, without prejudice to consumer protection rules of the user's country of residence, where applicable.
